Worcester staffing firm to pay $95K over Dudley workforce violations

Worcester agency Southern Mass Staffing will pay $95,000 in penalties for a labor scheme keeping minimum wage, overtime and sick time pay from hundreds of workers at a Dudley aerosol factory, according to the Massachusetts Attorney General's Office.

The settlement with Southern Mass Staffing and owner Mesa Som with Attorney General Maura Healey’s office resolves six civil citations in connection with staffing workers at Dudley-based Shield Packaging.

Healey's office said its investigation revealed Shield Packaging failed to provide minimum wage, earned sick time, suitable pay stubs and temporary worker notices to hundreds of workers between April 2015 and October 2016.

The settlement will see more than 270 workers receive restitution for earned sick time they didn’t get while on the job. 

The staffing agency provided between 50 and 100 temporary workers to Shield Packaging each day. According to the AG’s Office, Shield Packaging used Southern Mass Staffing to escape liability for wage and hour violations.

In November, the AG’s Office announced an agreement with Shield Packaging for the payment of a $1-million fine, including restitution to 480 affected workers.
