Boston Scientific hit with class action suit for robocall marketing

A Texas man on the National Do Not Call Registry is alleging Marlborough medical device giant Boston Scientific made unsolicited robocalls to him to market a spinal cord stimulation device.

Steven Sandoe of Weatherford, Texas filed the class action suit in a Massachusetts federal court over the weekend, which seeks injunctive and monetary relief for himself and any others on the list who received unsolicited calls from the company.

In his case, Sandoe claims the company made two prerecorded sales calls despite his number off limits to such calls.

Sandoe claims he has had no prior relationship with the company or any of its affiliates and never consented to contact from the firm.

The company’s calls direct consumers to its websites to market products, including the Spectra WaiveWriter spinal stimulation device meant to help relieve pain. The calls invite potential customers to attend a seminar called Treatment Options for Chronic Pain, which functions as a sales pitch to consumers.

In the call, the company told Sandoe it was calling on behalf of his pain management doctor from Texas-based Spine Works Institute. The call included no option to end the sales pitches, according to the lawsuit.

The company has not commented on the lawsuit.
