State fines builder over asbestos removal

The Massachusetts Department of Environmental Protection said it has fined Town and Country Builders of Whitinsville and its owner, Denis Latour, for allegedly failing to follow safe and legal asbestos removal procedures at a project in Uxbridge.

The MassDEP assessed a penalty of $37,625, but agreed to suspend $7,525 of it  provided the company doesn’t have repeat violations over one year, it said.

MassDEP said inspectors in December 2012  observed that more than 100 linear feet of asbestos-containing pipe insulation had been improperly removed from a multi-family residential property and found that the asbestos insulation had not been wet. The agency added that the work area had not been sealed off and air filtration units were not utilized during removal work, as required.

Additionally, MassDEP said it had not been notified in advance of the asbestos removal project, which is required by the state.

An attempt to reach Town and Country by phone this morning was unsuccessful.
