Court: Tesla can sell directly to customers

Tesla Motors can continue to sell its electric cars directly to Massachusetts customers after the state’s highest court threw out a lawsuit seeking to block Tesla sales.

The Supreme Judicial Court unanimously ruled that the Massachusetts State Automobile Dealers Association, along with Herb Connolly Chevrolet in Framingham and Fisker Norwood, did not have the legal standing to sue Tesla in a bid to halt direct sales of Tesla’s cars. Fisker, which filed for Chapter 11 bankruptcy 2013, hybrid cars were sold through the Norwood dealership alongside  Jaguar and Landrover vehicles.

The suit cited state law designed to block car dealers from abuses by car manufacturers. In its decision, the court stated that the law applied only to automobile manufacturers that had previously established dealers within the commonwealth.

According to court records, Natick has issued a license to Tesla that allows it to operate a sales office in the town.
