Millbury sewage company sued by AG for illegal dumping

A Millbury sewage disposal company is being sued by Attorney General Maura Healey's office for allegedly dumping septage and waste into the town's sewer system and skirting local sewage fees.

The company, Midstate Sewerage, is alleged to have violated the state's Clean Waters Act and the State Environmental Code when it didn't discharge its waste into the Upper Blackstone Water Pollution Abatement District treatment facility in Auburn.

The company also allegedly made misrepresentations to the state Department of Transportation about its compliance with a state contract to transport the waste to the facility.

Instead, the company installed an unauthorized septate storage tank at its own Millbury facility and violated the state's Hazardous Waste Management Act by failing to register with the state Department of Environmental Protection.

"We allege this company orchestrated an illegal scheme, that cost the residents of Millbury, risked the integrity of the sewer system, and created an unfair business advantage over its competitors," Healey said in a statement. "We will take action against companies who skirt our state laws and regulations for their own profit."
