Boston Scientific claims another European patent victory

Boston Scientific plans to bring the LOTUS Valve system to the European market next year.

Marlborough medical device maker Boston Scientific has scored another patent litigation victory across the Atlantic in a case resulting in the revocation of a competitor’s patent. 

The European Patent Office on Monday revoked the patent of Edwards Lifesciences Corporation for a heart valve system that Boston Scientific was found to have infringed upon last March in a German court. 

That finding, Boston Scientific said, is the sole basis for California-based Edwards Lifesciences’ patent suit in Ireland.

“While Edwards has the right to appeal the EPO's decision, Boston Scientific believes the Edwards patent revocation will have a positive impact on both suits,” the company said in a statement Monday.

Last month, a United Kingdom court affirmed that Edwards infringed on Boston Scientific’s patent.

A German appeals court is also expected to hear arguments in May and June in another case involving the companies in which Edwards has found to infringe on two Boston Scientific patents.
