Hologic scores two patent case victories

Marlborough medical imaging device firm Hologic has scored two legal wins to help protect the company’s intellectual property.
On Friday, Hologic was awarded $4.8 million in a lawsuit against California surgical device company Minerva Surgical for infringing on two of Hologic’s endometrial ablation technology patents.
As a result of a U.S. federal court finding Minerva infringed, Hologic will seek an injunction to prohibit Minerva from further manufacturing and selling the infringing device in the US.
Damages will continue to accrue until MInerva stops its infringing activity.
The suit was brought against Minerva in 2015, and Hologic alleged Minerva’s product infringes on patents related from Hologic’s acquisition of an endometrial ablation company in 2004.
A former executive from that company, Csaba Truckai, founded Minerva four years later and developed the company’s endometrial ablation device, which has been found to incorporate the same patented technology his old company sold to Hologic.
In another legal win, Japanese imaging giant Fujifilm was found by an administrative law judge of the U.S. International Trade Commission to have infringed on Hologic’s Selena Dimensions and 3Dimensions x-ray mammography systems.
The judge in the case recommended an exclusion order to prevent Fujifilm from importing the infringing products to the U.S. The company could be prohibited from selling and marketing the products in the U.S.
A final ITC ruling in that case is due by November.
