Court rules against Hologic in ongoing patent case

A California medical device firm says it has won a patent spat with Marlborough firm Hologic after a U.S. Court of Appeals has rejected Hologic’s appeal of a previous court decision. 

Hologic in a 2015 lawsuit against Minerva Surgical in Redwood City for its patent over a system for detecting perforations in a body cavity. Minerva challenged that claim, and the U.S. Court of Appeals for the Federal Circuit in Washington, D.C. found that patent invalid. 

On Wednesday, the court denied Hologic’s request for an appeal of that ruling. 

As a result of the April decision, the U.S. Federal District Court for the District of Delaware denied Hologic’s request to halt sales of Minerva’s Endometrial Ablation System based on the patent dispute. 

Hologic’s device in question was the NovaSure, which it acquired in 2007 after the buyout of Cytyc.

Wednesday’s update continues the ongoing patent war between the two firms. In July 2018, Hologic was awarded $4.8 million in damages from the Delaware court for alleged patent infringements. 

In a statement to WBJ, a Hologic spokesperson said this week’s ruling doesn’t affect that payment.
