Boston Scientific claims victory in UK heart patent case

Marlborough medical device maker Boston Scientific said in a press release early Wednesday a United Kingdom court has affirmed a decision that a California-based company infringed on the Boston Scientific's patent for a heart-valve device.

Boston Scientific sells its ACURATE neo Aortic Valve System in European markets, as does Irvine, Calif.-based Edwards Lifesciences with its Sapien 3 device.

In a statement, Desiree Ralls-Morrison, the Boston Scientific's senior vice president general counsel and corporate secretary, said the company’s intellectual property is further substantiated as a result of the ruling. 

"We see the U.K. court's decision as an important validation of our patents and supports our goal to bring differentiated solutions to patients suffering from severe and symptomatic aortic valve stenosis,” she said. 

Stateside, the Boston Scientific plans to appeal a finding from the U.S. Patent Office that some of its infringement claims against Edwards Lifesciences are invalid.

Boston Scientific is also eyeing CE mark application for the device, with the hopes of commercializing the product later this year and a clinical study for regulatory filings in the U.S.
