Father and son indicted for MassHealth fraud

A father and son serving as a personal care attendant surrogate and a PCA for a family member allegedly submitted fraudulent timesheets to MassHealth and defrauded the state’s Medicaid program of over $10,000.

Scott Gibeault, 51, of Southbridge, and his son Michael, 32, of Webster, were indicted by a Worcester County grand jury Tuesday with the charges of one count each of both larceny over $250 and Medicaid false claims.

After being indicted for four counts of Medicaid false claims and four counts of larceny over $250 by false pretenses in February 2016, Scott Gibeault continued to submit fraudulent timesheets to MassHealth between February 2016 and March 2017, Attorney General Maura Healey's office alleges. He was acting as the PCA surrogate for his adult son.

Michael Gibeault, who served as a PCA for his brother, was allegedly part of the scheme, and knowingly signed false PCA timesheets that his father submitted.

Michael Gibeault also allegedly signed false PCA timesheets for submission to MassHealth for times when he could not have provided services because he was either working at another job, receiving medical care, traveling or just wasn’t providing the services. As a result, MassHealth issued nearly $9,000 in unwarranted payments.

Both father and son will be arraigned in Worcester Superior Court at a later date.
