Sepracor, Wyeth In Patent Dispute

Marlborough pharmaceutical company Sepracor Inc. is claiming patent rights on an antidepressant drug made by New Jersey drug company Wyeth.

The U.S. Patent and Trademark Office's Board of Patent Appeals and Interferences will hear oral arguments on the issue on Jan. 6, 2010.

Sepracor argues that it submitted its first patent for a related drug on April 6, 1999, about 22 months earlier than Wyeth's earliest filing date. Wyeth received a patent for the drug, which it markets under the name Pristiq, and has been selling it since last year.
