Survey: More Business Litigation In Coming Year

Companies across the country are anticipating an increase in litigation in the coming year, according to international law firm Fulbright & Jaworski LLP.

Fullbright's 2008 Litigation Trends Survey found that businesses are preparing for litigation surrounding "who is to blame and who should pay for the consequences" of the country's current economic calamity.

An increase in litigation would buck a downward trend in litigation begun in 2005-06, when 11 percent of companies surveyed said they went an entire year without any new lawsuits to defend. In 2007-08, 21 percent of companies surveyed said they had no new lawsuits filed against them.

Fulbright said that period of time may prove to be "the calm before the storm."
