Texas Awards Doc. $431M In Boston Sci. Suit

A jury has awarded a Texas doctor $431 million in damages as the result of a patent infringement suit brought against Natick-based medical device manufacturer Boston Scientific Corp.

The suit was brought by Dr. Bruce Saffran in U.S. District Court in Marshall, Texas, was related to the company's TAXUS drug-coated coronary stent. The jury found that BSX's TAXUS Express and TAXUS Liberte stents infringe on Dr. Saffran's patent and that the patent is valid.

Boston Scientific said the verdict was unsupported by evidence and law, and will seek to overturn it in post-trial motions before the District Court. Should that fail, BSX will appeal the decision to the U.S. District Court of Appeals for the Federal Circuit.
