Bramble Hill developers take City of Worcester to court

Developers of a proposed age-restricted housing development at the former Bramble Hill mansion on Salisbury Street in Worcester have filed suit against the city.

The 10-page complaint in Boston Land Court asks the judge to overturn the Worcester Planning Board’s December decision to reject plans by property manager Premier Property Group LLC of Dunstable to replace the abandoned 119-year-old home with 123 apartments in three low-rise buildings.

In its ruling last year, the Planning Board said the 17-acre parcel is zoned for single-family residences. While a continuing care retirement community is allowed with a special permit, the five-member panel decided the proposal failed to meet the requirements.

But Premier argues its project conforms with every aspect of the zoning rules.

The proposed project is adjacent to Salisbury Hills, a senior community where another developer is seeking to add 114 single-family homes.

In January, Mark Donahue, the Worcester attorney from Fletcher Tilton representing developer Hills Properties of Cincinnati, Ohio who had made the presentation to the Planning Board, told the WBJ that the team was evaluating their next move.

Donahue declined comment on Thursday, given the lawsuit is pending.
