BSX Gets Win In Patent Case

A federal U.S. Court of Appeals affirmed a ruling that Natick-based medical device manufacturer Boston Scientific did not infringe on competitor Johnson & Johnson's stent system patents.

J&J in 2007 alleged that BSX infringed upon four of the company's patents related to coatings for drug-eluting stents. The U.S. District Court in Delaware initially ruled against J&J in the suit and BSX announced yesterday that a U.S. federal appeals court affirmed that decision.

The ruling frees Boston Scientific from potentially significant costs.

Last year, Boston Scientific agreed to pay $1.7 billion to J&J to resolve three other patent disputes.

In 2000, a judge ordered BSX to pay $324 million for patent infringement to J&J.
