New Chapter In Softscape Legal Battle

The legal war between human resources software makers Softscape Inc. of Wayland and SuccessFactors Inc. of California continued with the addition of another lawsuit last week.

Softscape has filed a lawsuit in Middlesex Superior Court accusing SuccessFactors of misappropriation of trade secrets, unfair competition and "tortuous" interference in contractual relation, according to Softscape. The lawsuit also charges that SuccessFactors has actively recruited Softscape employees for the proprietary information they have about the Massachusetts company.

Softscape charges that it has information that shows SuccessFactors accessed Softscape's confidential and secure computer systems from an Internet address that it says is registered to SuccessFactors.

SuccessFactors has publicly characterized this latest lawsuit as an attempt by Softscape to distract attention from its actions that led SuccessFactors to file a lawsuit against the Wayland company earlier this year.

In March SuccessFactors filed a lawsuit against Softscape in U.S. District Court in California, charging that Softscape illegally accessed its computer systems to take proprietary information to make a false PowerPoint presentation full of negative information about SuccessFactors.

The lawsuit charged Softscape with false advertising, trademark infringement and other allegations in creating the document, which Softscape said was only for internal use. SuccessFactors claims the presentation was sent anonymously to many of its customers.

A temporary restraining order was issued shortly afterward by the federal court prohibiting Softscape from using SuccessFactors trademarks or secret information, improperly accessing the company's computer systems or making statements purported to be made by anyone other than Softscape.
