Patent Office Clears Way For Suit Against Candela

The U.S. Patent and Trademark Office has confirmed the validity of 56 Palomar Medical Technologies Inc.'s claims under re-examination as part its ongoing lawsuit with Wayland-based Candela Corp.

Both Palomar and Candela make lasers used in cosmetic and other medical procedures. Palomar sued Candela for patent infringement last year. The lawsuit was stayed pending the outcome of the trademark office's re-examination.

Only two of the 58 patent claims in question were determined to be invalid by the trademark office. The trademark office is still in the process of re-examining a separate series of patents disputed by the two companies.

In a statement, Candela said it remains confident that it has not infringed upon patents owned by Burlington-based Palomar. The series of patents in question were licensed to Palomar by Massachusetts General Hospital.

Palomar said in a statement, "We look forward to re-starting the patent infringement lawsuit against Candela as quickly as possible."
